Stalking
A person commits stalking when all of the following occur:
1. The person purposefully engages in a “course of conduct,” as defined below, directed at a victim that would cause a reasonable person to fear bodily injury to, or the death of, the victim or a member of the victim’s immediate family;
2. The person knows or should know that the course of conduct will place the victim in reasonable fear of bodily injury to, or the death of, the victim or a member of the victim’s immediate family; and
3. The course of conduct does in fact induce fear in the victim of bodily injury to, or the death of, the victim or a member of the victim’s immediate family.
“Course of Conduct” means repeatedly maintaining a visual or physical proximity to a person without legitimate purpose or repeatedly conveying oral or written threats, threats implied by conduct, or a combination thereof, directed at or toward a person.
Procedures for Reporting Stalking.
Any student, faculty, or staff member who believes he or she is a victim of stalking should immediately contact the Des Moines Police Department at 9-911. Campus Security should also be notified by calling 811.
In addition to being a crime under Iowa law, stalking also constitutes non-academic misconduct punishable under the University’s Code of Conduct. Any student who believes he or she has been or is being stalked by a Drake student or employee may make a complaint to the Dean of Students or may may file a complaint at the Student Life Center in the Olmsted Center.
